Eビザカンパニーの国籍

• Eビザカンパニーとなる米国拠点は、申請者と同じ国籍でなくてはなりません。日本人を派遣するのであれば米国拠点の株式の最低50％を日本人（永住権を持つ日本人を除く ）、または日本企業が保有していることが求められます。株式を保有する日本企業も同様に株式の最低50％を日本人（永住権を持つ日本人を除く ）または日本企業であることが求められます。

• 永住権を持つ日本人は、日本国籍の株式としてカウントされません。

• 株主がある国の株式市場にのみ上場されている企業の場合、その国をその企業の国籍とみなすことができるとされています 。

  • 有価証券報告書の外国法人等の所有株式数の割合で日本人（日本企業）が50％を下回っていても日本企業と判断するというのが大使館の見解です。

• 非上場の企業の場合、法人税申告書の「同族会社等の判定に関する明細書」を提示し、そこに記載されている株主の国籍を示すことが求められます。

• 株主が個人の場合、パスポートコピーなどを提出する必要があります。

• Eビザカンパニーとして認められていても、海外の投資家や外資系のファンドの資本参加するなどで日本人の株式保有比率が50％を切ると、Eビザの資格を喪失します。その場合Eビザでの滞在ができなくなり、家族も含め他のビザの滞在ステータスへの変更と新しいビザの取得が必要となります。
